Welcome to the services operated by Function People LLC ("Function People," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, products, and services (collectively, the "Platform").

Function People is not responsible for third-party services or for any acts, omissions, content, policies, downtime, security issues, or data handling practices of those third parties.
As between you and Function People, you retain ownership of your User Content, subject to any rights granted in these Terms.
By submitting, posting, uploading, syncing, or otherwise making User Content available through the Platform, you grant Function People a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, display, perform, distribute, transmit, and otherwise use that User Content solely as necessary to:

If you believe content on the Platform infringes your copyright or other intellectual property rights, you may submit a notice to us at contact@functionpeople.com. Your notice should include sufficient information for us to identify the material and evaluate the claim.
The Platform may contain links to or integrations with third-party websites, services, applications, or resources. We do not control and are not responsible for any third-party services. Your use of third-party services is at your own risk and subject to the third party’s own terms and policies.
Your use of the Platform is also subject to our Privacy Policy, which describes how we collect, use, and disclose information. By using the Platform, you acknowledge that your information will be handled in accordance with our Privacy Policy.
You may stop using the Platform at any time. We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, created risk for us or others, or if we are required to do so by law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Function People DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
Function People DOES NOT WARRANT OR GUARANTEE THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY USER CONTENT OR THIRD-PARTY DATA MADE AVAILABLE THROUGH THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Function People LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF Function People FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO Function People FOR USE OF THE PLATFORM IN THE 12 MONTHS BEFORE THE CLAIM AROSE; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
You agree to defend, indemnify, and hold harmless Function People LLC and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:
These Terms and any dispute arising out of or relating to them or the Platform will be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles, unless otherwise required by applicable law.
Any disputes arising out of or relating to these Terms or the Platform will be resolved through binding arbitration on an individual basis, except that you may assert claims in small claims court if they qualify. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We may modify these Terms from time to time. If we make material changes, we will provide notice, such as by updating the effective date or providing in-product notice. Your continued use of the Platform after the changes take effect constitutes your acceptance of the revised Terms.
